Regarding the decision to exclude the song “Jabra Fan” from the film Fan, which stars Shah Rukh Khan, the Supreme Court of India has decided in favor of Yash Raj Films (YRF). The National Consumer Disputes Redressal Commission (NCDRC) issued a ruling in 2021 that compelled YRF to pay a compensation of Rs 10,000 to a moviegoer who thought that they were misled by the absence of the song in the film. This verdict overturns that order.
The Supreme Court has ruled in favor of Yash Raj Films in the case known as “Jabra Fan.”
The lawsuit was brought about as a result of a complaint that was submitted by Afreen Fatima Zaidi. She put out the argument that she and her children were dissatisfied with the decision to exclude “Jabra Fan” from the film after having seen it promoted in trailers. Zaidi had said that the health problems that her children had were a direct result of her disappointment. Zaidi was first supported by the NCDRC, which ruled that the promotional strategy violated the Consumer Protection Act since it was considered an unfair trading practice.
YRF, on the other hand, filed a challenge against this ruling at the Supreme Court, arguing that the song “Jabra Fan” was merely a promotional track and was not required to be included in the final film. Finally, a bench of the Supreme Court that was led by Justices P.S. Narasimha and Aravind Kumar came to the conclusion that the YRF’s position was correct. In light of the decision made by the court, the line between promotional content and the finished film product has been made more clear.
“We have developed a plan to determine what the ramifications of a promotional song and trailer are, as well as the contractual duties that are associated with them. The Supreme Court Bench stated that they had granted permission for the appeal.
